1. Acceptance of Terms

By accessing or using the CWP Game Day Command Center, cwpweatheralerts.com, or subscribing to email, text, or push alerts (collectively, the "Service"), operated by CWP Media Group Texas ("CWP," "we," "us"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

The Service displays weather conditions, National Weather Service alerts, and an automated heat/safety assessment for selected athletic facilities, and optionally sends alerts by email, SMS, and/or browser push notification to subscribers who opt in.

3. Not an Emergency Notification System

The Service is informational and supplementary only. See our Disclaimer, which is incorporated into these Terms by reference. Always follow local authorities and your organization's official safety protocols.

4. Alert Delivery Is Best-Effort Only

Alerts are provided on a best-effort basis and are not guaranteed to be delivered, delivered on time, or delivered at all. Email may be delayed, filtered as spam, or blocked by a recipient's mail provider. Text alerts are sent through free carrier email-to-SMS gateways, not a dedicated SMS platform, and delivery is not guaranteed by any carrier. Push notifications depend on your device, browser, operating system settings, and connectivity, and may be delayed or silently fail. Underlying weather data itself may be delayed or interrupted, including during outages of National Weather Service systems.

To the fullest extent permitted by law, CWP Media Group Texas is not liable for any injury, death, property damage, or other loss or damage of any kind arising from a delayed, missed, incomplete, or inaccurate alert, or from reliance on any information provided through the Service. You are solely responsible for independently monitoring weather conditions and making your own safety decisions.

5. Subscriptions and Cancellation

You may subscribe to alerts for one or more facilities and choose your preferred channels (email, text, push) and repeat-notification interval. You may update your preferences or unsubscribe at any time using the personal management link included in every alert, or the link provided at signup, at no cost.

6. Acceptable Use

You agree not to misuse the Service, including attempting to circumvent rate limiting or bot protection, submitting false subscriber information, or using automated means to scrape or overload the Service.

7. Intellectual Property

The Service's design, software, and original content are owned by CWP Media Group Texas. Weather data itself is sourced from the National Weather Service, a public resource of the U.S. government.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

9. Limitation of Liability

To the fullest extent permitted by law, CWP Media Group Texas and its officers, employees, and contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of life, personal injury, or property damage, arising out of or related to your use of, or inability to use, the Service — including reliance on any weather data, alert, or safety recommendation it provides.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after a change constitutes acceptance of the revised Terms. The "Last updated" date above reflects the most recent revision.

11. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
